A California HOA violation or fine notice: what to gather first
Separate an allegation, a proposed fine, a hearing notice and a final decision. Save the actual document and envelope or delivery record. Identify the conduct alleged, the provision cited, the requested correction and every date. A notice alone does not establish that the association’s interpretation or process is correct. Recent statutory changes make relying on an old fine schedule especially risky.

What the California sources address
The acquired version of §5850, amended by AB 130 effective June 30, 2025, limits ordinary violation fines to the lesser of the effective fine schedule or $100 per violation. Its health and safety exception requires a specified written finding at an open board meeting. It also prohibits late charges or interest on monetary penalties.
Section 5855 requires written notice at least 10 days before the disciplinary meeting, identifies required notice contents, provides a cure opportunity, and requires written notification within 14 days after an imposed sanction. Cure, a financial commitment to cure when more time is needed, and internal dispute resolution have specific statutory conditions; reimbursement for damage is separately addressed.
Example: keep a corrected landscaping photo with its date, the notice, the cited rule and proof of your response. Ask the board to address the cure provision before the meeting. Do not treat an assessment debt and a disciplinary fine as the same charge.
Prepare your next step
- Compare the cited restriction with the current rule, declaration and any amendments; ask for the text if it was not supplied.
- Request the policy or fine schedule relied on and the procedure for responding, correcting the issue and requesting a hearing.
- Prepare a short factual response, relevant correspondence and questions; keep originals of photos and notices.
- Seek qualified advice about a disputed sanction or urgent deadline. Check current California requirements; older dollar limits or procedures may have changed.
A starting point for your request
Please identify the current governing provision and disciplinary policy used for this notice, the proposed action, and how I can respond or request a hearing. Please confirm the dates and how a correction or dispute will be considered.
