California CC&Rs, bylaws and rules: build a current document set
A resale packet, an old owner handbook and a current recorded declaration are not interchangeable. Start an inventory with the title, date, source and amendment history of each document. Note when an association representative confirms a version is current. A Secretary of State corporate record can help establish an entity’s identity but is not a substitute for the community’s complete governing documents.

What the California sources address
Section 4150 identifies governing documents. Section 4205 sets a hierarchy for conflicts: law, declaration, articles, bylaws and operating rules have different priority. A restriction’s presence in a handbook does not establish that it overrides a statute or recorded declaration.
Section 4525 describes documents involved in a prospective transfer, including governing documents and disclosures. A resale package is useful evidence, but dates, amendments and completeness still need checking. An unincorporated association should not be described as a corporation simply because a similar name appears in a search.
Example: when a parking rule cites an old CC&R section, ask for the declaration, the relevant recorded amendments and the adopted rule. List each document’s date and source before asking about an apparent conflict.
