Requesting California HOA records: prepare a focused request

A request for ‘all HOA documents’ can make it hard to identify what is missing. Start with the decision you are trying to understand: a charge, an election, a repair or a rule. Name the record that would help answer it, identify the relevant period and keep a dated copy of your request. Distinguish association records from records held by a government office; they are different sources and can have different access processes.

What the California sources address

Civil Code §5205 addresses member inspection and copying, including a written designation of a representative. A focused request should identify the records and fiscal periods you want, rather than asking for every association document.

Section 5210 distinguishes current-year records, prior-year records, permanently available minutes and certain inspection reports. Its deadlines depend on the requested category. Section 5215 permits specified privacy and privilege redactions; access is not a right to another owner’s confidential information.

Example: for a repair assessment, request the adopted budget, the relevant meeting minutes and the identified project estimate. Keep the association’s receipt date so you can compare its response with the correct §5210 category.

Prepare your next step

  1. List each requested record separately, such as the adopted budget, an approved meeting minute or the current declaration and amendments.
  2. Ask which records are available for inspection, which can be copied and what copying or redaction charges are proposed before authorizing costs.
  3. Keep a log of delivery, acknowledgment, records supplied and items withheld. Ask for the stated basis for withholding an item.
  4. Verify current California access rules for your community and record type before asserting a deadline or remedy.

A starting point for your request

Please tell me how to inspect or obtain [record] for [date range]. Please identify any proposed copying costs and any part you cannot provide, with the reason. I am requesting association records rather than personal information about other owners.
