Preparing for a California HOA election question

Identify what is being decided and who is entitled to vote before assessing an election process. Director elections, document amendments and assessment votes may involve different prerequisites. Preserve the notices and rules that were actually distributed, rather than a website summary that may have changed. Electronic voting and election procedures require current sources; an older paper-ballot checklist may be incomplete.

California association owners; community type and governing documents require confirmation. Evidence reviewed: 2026-10-18. Official code snapshot: 2026-10-12.

What the California sources address

Section 5105 addresses election operating rules, including candidate access and procedures. Section 5110 addresses independent election inspectors and their responsibilities. A management company’s involvement does not by itself establish an eligible independent inspector.

Section 5120 addresses public counting and tabulation, reporting results, and election materials. Its 2025 version must be read alongside the rules for the actual voting method. Do not assume an older paper-ballot handbook describes a current electronic election.

Example: if nomination instructions conflict, save both versions and ask the announced inspector which adopted rule controls, when it was distributed, and how the association will resolve the discrepancy. Do not send your marked ballot to a public support form.

Prepare your next step

  1. Record the election type, notice dates, nomination process and scheduled counting or meeting date.
  2. Request the current election rules and the announced inspector or contact for procedural questions.
  3. Keep the instructions and materials you received without sharing another owner’s ballot or private details.
  4. Raise a specific procedural question in writing and seek timely advice if you are considering a formal challenge.
