Understanding a California HOA special assessment notice
Before deciding how to respond, identify whether a charge is a regular assessment, a special assessment or another fee. Record the amount, purpose, due dates and payment instructions. Ask what decision approved the charge and what materials explain your share. A reserve shortfall, emergency expense and planned improvement can raise different questions; do not assume a single voting rule resolves every case.

What the California sources address
Section 5605 separately addresses regular-assessment increases and aggregate special assessments. Do not apply a regular-assessment percentage to a special assessment, or assume a rule has no exceptions. Sections 5605 and 5610 contain additional conditions and exceptions that must be checked in the actual text.
An explanation of the project cost is different from proof of the required approval. Ask for both the cost calculation and the meeting or election record relied on. Section 5650 addresses assessment collection consequences, so withholding payment requires timely professional advice.
Example: a roof assessment arrives with a single amount but no allocation worksheet. Ask for the adopted project budget, your allocation basis, approval record, due dates and the provision supporting any emergency exception.
Prepare your next step
- Collect the notice, adopted budget, relevant reserve material, project estimate and approval record.
- Ask how the association calculated the total and your allocation, and what assumptions may change the estimate.
- Identify whether the association relies on a member vote, board approval or an asserted exception; request the supporting record.
- Verify current assessment and collection rules before deciding to withhold payment. A dispute does not make nonpayment safe.
A starting point for your request
Please provide the budget or project materials supporting the assessment, the record of approval, the basis for allocating my share and the payment schedule. If an exception to the ordinary approval process is being used, please identify it.
